The applicant has stated that no structures or renewable resource lands <br />are present within the mining limit for the 5-year permit term (pa ye 138). <br />The Division does not have sufficient information to concur with this opinion. <br />Responses to questions raised in the Ground [/ater portion cif this document will. <br />indicate the presence or absence of aquifers which could be impacted by subsidence. <br />XXIV. Special Categories of Afining - Rules 2.06, 9.22, 4.23, 4.26, 4.27, 9.28 <br />and 4.20 <br />Deficiencies: <br />1. The applicant needs to discuss whether any support facilities riot located <br />at t)~e mine site will be used. If so, the applicant needs to address the <br />requirements of 9.28. <br />.K:iV. Support facilities off-site (4.28) have been addressed in the special <br />categories of mining. (Section XXIV of this document). <br />De fi ci enci es: <br />1. The applicant should commit to proper placement and maintenance of all <br />necessary signs and markers (per Rule 4.02). For the Animas mine these should <br />include mine permit and I.D, signs, perimeter markers, and, topsoil markers. <br />2. The applicant should discuss any e:rploration activities being conducted. <br />'Gh_s discussion should address the requirements of Rule 4.21, and should include <br />copies of a Notice of Intent issued by the Division. <br />_. T,4e applicant needs to specifically address the requirements of Rule 4.30, <br />C.'essa ti on of Operations. This discussion should comrut the operator to the <br />requirements for temporary and permanent cessation of operations. <br />XY.VI. Operations on Lands Subject to Prohibitions or Limitations - Rules <br />2.03.7 anc7 2.Z0 <br />Findings: <br />1. •The operation is not in an area which has been designated unsuitable far <br />mining, nor is the operation in an area which is under study for designation <br />as unsuitable for mining. <br />
