This nest is on private lands; however, activities on federal <br />lands may have a negative effect on the eagle nest. At this time <br />the status of this nest is unknown. The nest location was discovered <br />in 1976 by consultants working for ARCA.. There has not been any <br />• follow-up since that time to determine if the nest has been active. <br />Pending final approval from the U.S. Fish and Wildlife Service. s <br />1/4-vile buffer zone around this nest will be considered unsuitable.- <br />• This buffer zone will also apply ix arty eagle nests discovered in <br />the future. <br />Exceptton: The buffer zone could be considered suitable for' <br />underground mining with the folloring stipulations. Surface <br />-_ ~ facilities. occupancy. surface disturbance, industrial fires, and <br />subsidence will rat be permitted in the eagle nest buffer zone. <br />Some surface activities mey be permissible in the buffer zone at <br />times other than the breeding/rearing season (March 1 to July 1) <br />or if the nest is inactive. This will require further study on a <br />sitrspeeiflc basis. Arty future activity in, or adjacent ta. <br />thus buffer nines must bt approved by the U.S. Fish acrd M1ldlife <br />Service and Bureau of Land Management. ' <br />Criterion Number 12: Bald aed Golden Eag1a Roost Concentration Areas .._ ._. _. __.. <br />Analysis: There are no known roost or concentration areas in the <br />1 ease era. <br />Criterion Number 13: Falcon C11fi Nesting Sites _ <br />•Analysis: There are no known nesting sites. although prairie <br />falcotrs have been documented on the lease area and peregrine <br />falcons could oewr on the site. <br />Criterion number 14: Migratory 81rds <br />Analysis: The Cooper's Hark occurs and oasts on the lease tract. <br />A nest has been located on the lease tract. The nest is located <br />within the area proposed. for surface facilities (T. 133.. R. 9011., <br />See. 16, SW'1/4 SE1/4 Nif1/4, 5th P.M.). Activities in the drnlroge, <br />wham the nest is lou fed. from approximately the 6760 foot level <br />up to the ridge top and 1/8th mile on either side of the drainage <br />botinaa (see map) are unsuitable. <br />Nearly half of the spades of high federal interest depend upon <br />riparian habitat for at least a portion of their life cycle. A11 <br />riparian zonal plus a 1/8-utla buffer strip on etch side of xhe <br />perennial and ephemeral streams should be classed as unsuitable. <br /> <br />
