Criterion h;n Ser ii: Czld and Golden Eagle I,es a <br />Analysis: There are no bald eagle nests. 7here.is one known <br />- golden eagle nest in T. 135., R. 90W., Sec. 31, Nldl/4 Ilbl1/4, 6th <br />P.M. This nest is on private lands; however, activities on federal <br />lands may have a negative effect on the eagle nest. At this time <br />the status of this nest is unknown. The nest location was discovered <br />in 1976 by consultants working for ARCO. There has not been any <br />follow-up since that time to determine if the nest has been active. <br />Pending final approval from the U.S. Fish and 4ildlife Service, a - <br />1/4-mile buffer zone around this nest will be considered unsuitable. <br />This buffer zone will also apply to any eagle nests discovered in <br />the future. <br />Exception: The buffer zone could be considered suitable for <br />underground mining with the following stipulations. Surface <br />facilities, occupancy, surface disturbance, industrial fires, and <br />subsidence will not be permitted in the eagle nest buffer zone. <br />Some surface activities may be permissible in the buffer zone at <br />times other than the breeding/rearing season (March 1 to July 1) <br />or if the nest is inactive. This will require further study on a <br />site-specific basis. Any future activity in, or adjacent to, <br />these buffer zones must be approved by the U.S. Fish and Wildlife <br />Service and Bureau of Land Management. <br />Criterion Number 12: Bald and Golden Eagle Roost Concentration Areas <br />Analysis: There are no known roost or concentration areas in the <br />lease area. <br />Criterion Number 13 <br />Analysis: There <br />falcons have been <br />falcons could occ <br />Criterion Number 14: <br />Falcon Cliff Nesting Sites <br />are no known nesting sites, although prairie <br />documented on the lease area and peregrine <br />ur on the site. <br />Migratory Birds <br />Analysis: The Cooper's Hawk occurs and nests on the lease tract. <br />A nest has been located on the lease tract. The nest is located <br />within the area proposed for surface facilities (T. 135., R. 90W., <br />Sec. 16, SW1/4 SE1/4 NWl/4, 6th P.M.). Activities in the drainage, <br />where the nest is located, from approximately the 6760 foot level <br />up to the ridge top and 1/8th mile on either side of the drainage <br />bottom (see map) are unsuitable. <br />Nearly half of the species of high federal interest depend upon <br />riparian habitat for at least a portion of their life cycle. All <br />riparian zones plus a 1/8-mile buffer strip on each side of the <br />perennial and ephemeral streams should be classed as unsuitable. <br />
