are outwash colluvium from the steep slopes north of the loadout. <br />Therefore, the geology of the loadout area does not meet the geologic <br />definition of alluvial valley floors. <br />In addition, the slopes of the loadout facility prior to disturbance <br />generally ranged between 12 and 15 percent (7 to 8.5 degrees). <br />Geomorphically, the angle of these slopes would indicate an "outwash" <br />rather than a "stream-laid" deposit. <br />Although the pre-disturbance land use of the loadout area was <br />irrigated agriculture, the method for irrigation consisted of <br />channeling water from the Deer Trail Ditch to the fruit trees and hay <br />land by small distribution channels. The source of water for <br />irrigation of the site came from well above the North Fork of the <br />Gunnison River. The area has not been flood irrigated due to the <br />slope of the land surface, the lack of sufficient volume of water, and <br />the height above the North Fork of the Gunnison River. <br />In addition, no subirrigation occurs at the loadout site. This was <br />confirmed as no ground water was encountered during excavation of the <br />"pad" area for the loadout facility. The excavation was completed to <br />approximately 20 feet below the ground surface. <br />Location of the Terror Creek Company Loadout facility is approximately <br />85 feet above the North Fork of the Gunnison River. Due to the <br />elevation difference between the loadout area and the North Fork of <br />the Gunnison River, natural flood irrigation of the site would be <br />practically impossible from water of the North Fork of the Gunnison <br />River. In addition, the loadout should have no effect on the flood <br />irrigation and subirrigation capabilities of the North Fork of the <br />Gunnison due to its relative position to the loadout facility. <br />Terror Creek Company strongly believes that the loadout site should <br />not be classified as an AVF. If the Colorado Mined Land Reclamation <br />Division maintains the preliminary determination that the loadout area <br />is an AVF, then Terror Creek Company will only accept that conclusion <br />
