<br />~., <br />i <br />the meeting with Greg Lewicki on October 20, 1992, the Division is <br />remiss in their statutory obligations to approve a permit without <br />adequate baseline data. Furthermore, to enforce this obligation <br />inconsistently to operators around the state, would allow some <br />operators an unequal competitive advantage. <br />This site has historically had some acid mine drainage problems <br />associated with the Victory 3 Mine. The proposed mine plan calls <br />for a gravity-fed mine in an area known to have pockets of acidic <br />rock. In requiring thorough baseline information, the Division is <br />asking for information which will help Pennsylvania West better <br />understand the inherent assets and liabilities at the site, as <br />well as enable the Division to feel confident that reclamation will <br />be feasible and that there will be no off-site damage from mining. <br />The Division will permit a mine with acid-generating conditions, as <br />long as the long-term reclamation plan is adequate to ensure no <br />off-site impacts to the hydrologic balance. <br />We are looking forward to the receipt of the water sampling <br />information collected in late October. <br />Sincerely, <br />Harry Ranney <br />Reclamation Specialist <br />cc Cathy Begej <br />m:\wp51\cogul.cwb <br />
