During the course of the permit review, a number of concerns arose regarding <br />the control of reference areas and reference area comparability. The <br />applicant has proposed, in meetings with the Division, an extended reference <br />area concept. This discussion and the extended use of the proposed reference <br />area concept has not been discussed or clarified in the permit application. <br />Therefore, it is stipulated: <br />Stipulation No. <br />PRIOR TO PERMIT ISSUANCE, THE APPLICANT SHALL ADEQUATELY ADDRESS THE <br />USE OF THE EXTENDED REFERENCE AREA CONCEPT OR OTHER MEANS FOR SETTING <br />RECLAMATION SUCCESS CRITERIA FOR THE SENECA II-W MINE. THIS CONCEPT <br />AND ALL RECLAMATION SUCCESS CRITERIA REGARDING THIS CONCEPT SHALL BE <br />SUBMITTED TO THE DIVISION AND APPROVED IN WRITING PRIOR TO PERMIT <br />ISSUANCE. <br />With regard to the proposed reclamation plan, a number of concerns were <br />identified during the review concerning seed mixes, a time/table for seeding, <br />a revegetation monitoring plan, a species diversity evaluation plan, <br />irrigation and pest control measures. These issues have not been adequately <br />addressed in the resubmitted permit application, therefore, it is stipulated <br />that: <br />Stipulation No. <br />THE FOLLOWING ASPECTS OF THE SENECA II-W REVEGETATION PLAN WILL BE <br />IMPLEMENTED OR MODIFIED AS STATED BELOW: <br />A.) SEEDING AND PLANTING SHALL BETWEEN MARCH 15 AND JUNE 1 AND/OR <br />AUGUST 15 THROUGH NOVEMBER 15 OF EACH YEAR. <br />8.) THE APPLICANT SHALL REVISE ALL SEED MIXES TO REMOVE ALFALFA AND <br />PUBESCENT WHEAT GRASS FROM THEM AND SUBSTITUTE SPECIES AND <br />SEEDING RATES ACCEPTABLE TO THE DIVISION. <br />C.) THE APPLICANT SHALL REVISE ALL SEED MIXES TO INCORPORATE <br />SPECIFIC SEEDING RATES OF PLANTING FOR SHRUB AND FORB SEEDS. <br />D.) ALL PEST AND DISEASE CONTROL MEASURES SHALL BE APPROVED BY THE <br />DIVISION IN WRITING PRIOR TO INITIATION. <br />E.) THE APPLICANT SHALL DEVELOP AND SUBMIT AN ACCEPTABLE SPECIES <br />DIVERSITY STANDARD TO THE DIVISION PRIOR TO PERMIT ISSUANCE. <br />F.) WITHIN 90 DAYS OF PERMIT ISSUANCE, THE PERMITTEE SHALL DEVELOP <br />AND SUBMIT FOR DIVISION APPROVAL A BIENNIAL REVEGETATION <br />MONITORING PLAN FOR THE SENECA II-W PERMIT AREA. <br />G.) THE APPLICANT SHALL COLLECT AND SUBMIT TO THE DIVISION CROP <br />PRODUCTIVITY INFORMATION FOR THE CROPLANDS TO BE DISTURBED BY <br />THE SENECA II-W PERMIT COAL MINING OPERATIONS ON A YEARLY BASIS <br />UNTIL SUCH TIME AS THE DIVISION HAS DETERMINED THAT AN ADEQUATE <br />REPRESENTATION HAS BEEN MADE OF THE CROP PRODUCTION IN THE AREA <br />AND A CROPLAND REVEGETATION SUCCESS CRITERIA HAS BEEN <br />ESTABLISHED. <br />
