Savage <br />RE: Proposed Findings for the Seneca II-W Mine (our File No. C-057-82j <br />I have reviewed the climatological and air resources, vegetation and <br />revegetation plan, and fish and wildlife and fish and wildlife mitigation <br />sections of the Seneca II-W permit application and have prepared the following <br />proposed findings: <br />Climatological Information and Air Resources - <br />Peabody Coal Company has submitted climatological baseline information in Tab <br />8 (Volume V) and initially approved Emission Permit No. 82R0258 in the Tab 14 <br />of Volume IX of the permit application. The applicant has provided the <br />required information and the proposed operation is in compliance with the <br />requirements of this section. <br />XII. Vegetation - Rules 2.04.10, 2.05.4(ii)(e), 4.15, and 4.18.04(ij <br />The Division has reviewed the permit application for compliance with the above <br />sections. Information on baseline vegetation for the Seneca II-W permit area <br />can be found in Tab 10 of Volume VI. Information on the revegetation plan and <br />revegetation success criteria for the proposed permit area can be found in Tab <br />13 of Volume IX of the permit application. <br />During the course of the permit review, the applicant elected to move the tie <br />across haul road corridor. The Division requested that the applicant provide <br />verification that the vegetative communities observed in the new haul road <br />corridor corresponded to those in the old haul road corridor. To date, the <br />applicant has not provided this information. Therefore it is stipulated: <br />Stipulation No. <br />PRIOR TO PERMIT ISSUANCE, THE APPLICANT WILL PROVIDE BASELINE <br />VEGETATION INFORMATION FOR ALL NATURAL COMMUNITIES TO BE DISTURBED IN <br />THE NEW HAUL ROAD CORRIDOR WHICH DEMONSTRATES THAT THE NEW HAUL ROAD <br />CORRIDOR VEGETATION COMMUNITIES ARE EQUIVALENT TO THOSE PROPOSED TO BE <br />DISTURBED IN THE OLD HAUL ROAD CORRIDOR.
