Information contained in <br />the referenced application shows that erosion is adequately controlled and <br />failure of the reclaimed area is prevented. The topography as described <br />in the reclamation plan "closely resembles the general surface configura- <br />tion of the land prior to mining and blends into and complements the <br />draining pattern of the surrounding terrain". The postmining topography <br />is shown to be stable and capable of supporting anticipated land use. <br />There will be an increased stability over those conditions extant <br />at the time operations began. Figures 2.2-12.11 through 2.2-12.34 and <br />Appendix N of the permit application show clearly the enhanced stability, <br />not only over the life of the operation (not a consideration under this <br />variance), but following reclamation. <br />The improved stability is the critical aspect of my requested variance <br />to AOC Requirements. Improved stability lends itself to prevention of <br />significant deterioriation of surface water quality, vegetative cover and <br />aesthetics.
