Munson <br />Senior Reclamation Specialist <br />Colorado Mined Land Reclamation <br />1313 Sherman Street, Room 423 <br />Denver, Colorado 80203 <br />• III IIIIIIIIIIIII III, <br />INC. ~ ~° <br />ryn <br />~~ <br />Re: Request For Variance From Approximate <br />Original Contour Requirements - Munger <br />Canyon, File No. C-020-81. <br />Dear Brian: <br />At your behest, I am submitting this request for variance from <br />approximate original contour (AOC) requirements pursuant to Colorado <br />coal mining and reclamation regulation § 2.06.5, which allows for the <br />approval of certain exceptions to the AOC requirements. <br />This variance request is not used as an opportunity to present new <br />facts, only to identify the appropriateness of the variance, and com- <br />pliance with the intent and principle of AOC. <br />Legislative history supporting the Surface Mining Control and Reclama- <br />tion Act of 1977, and thereby as reference, also supporting the Colorado <br />Surface Coal Mining Reclamation Act, 34-33-101 et seq., defines approximate <br />original contour as "That surface configuration achieved by backfillin9 and <br />grading of the mine area so that the reclaimed area, including any terracing <br />or access roads, closely resembles the en9 eral surface configuration of <br />the land prior to mining and blends into and complements the draining pattern <br />of the surrounding terrain, with all highwall and spoil piles eliminated***" <br />(emphasis added)1. Also attached are diagrams taken directly from House <br />Report No. 95-2]8, April 29, 1977 that i]lustrate the concept of AOC. From <br />this example one can easily see that Munger Canyon reclamation is as was in- <br />tended. <br />The requested variance is for the work bench site and the access road <br />to that site. The road had to be cut into the hillside to allow for access <br />to the coal seam, and to provide a means of necessary coal haulage. These <br />features are shown in detail in Figures 2.2-2, 2.2-4, 2.2-8 through 2.2-14 <br />and 3.1-1. <br />1 House Report No. 95-218, April 29, 1977, page 97. <br />
