Bear: <br /> <br />AUu :': G iJ;~ <br />Z4 AUG 1379 f~'iir ~; L;'.: i;', , <br />„~, ~ <br />As I indicated to you at our meeting on August 20, 1979, a:e have evaluated <br />the proposed modifications to the federally-approved mine plan for the Bear <br />Mine to determine whether the proposed action is a "major" modification. I <br />leave determined that the modifications proposed (1) to provide adequate <br />ventilation to existing tirorkings through three new portals, (2) to construct <br />long-needed sediment control facilities, and (3) to provide access to the <br />ventilation portals using an upgraded and in part new road, are minor modi- <br />fications. In view of the previous (1964) approvals given to the Bear Mine <br />by the Department to mine the coal in the area located west of the proposed <br />entries, extending to tfre section line between Sections 16 and 17 (T13S, <br />R9011), the proposed mining of the coal (but only that coal) through these <br />entries 15 considered to be implementation of the previously-approved plan. <br />I must emphasize that this decision is based on the fact that the entries <br />will not be used to convey any coal mined from outside the area delineated <br />on Attachment I. If these entries are to t~e used for conveying coal from <br />other locations, or are used after mining 1n the t15I rs of Section 16 is com- <br />pleted, for other than ventilation and an escape route, Bear Coal and any <br />other operator will have to submit a new proposal to the Department. <br />I have also determined, based on staff reviews and other Departmental and <br />State evaluations of potential compliance of the Bear Mine proposals with <br />30 CFR Paft 211, that the proposal is acceptable, provided 1 receive your <br />written acceptance of the stipulation contained in Attachment II. <br />This letter 1s .therefore, approval for you to un~lertake the contraction of <br />the proposed actions providing the stipulation (Attaciner:t II) 1s accepted. <br />These proposed actions consist of ventilation tunnels, the fan portal access <br />road, the substation, and the two sedla;entatio:~, ponds and accomplishing any <br />and all remedial actions on surface sedi::rent. control facilities and disturbed <br />areas required to bring sediment and r:atr_r r:Lntrol practices into compliance <br />with the applicable regulations.
