The description must also include vrhat considerations vrere made to make the <br />postmining land use consistant vrith surface ovrner plans and applicable State and <br />local land use plans and programs. <br />3. Snovmass must state that the land will be restored in a timely manner to <br />conditions that are capable of sun ortin the uses vrhich the vrere ca able of <br />supporting before any mining or to achieve better or higher uses 4.16.1 or <br />apply to the Division for a finding to change the P.M.L.U. <br />4. Any change in P.I9.L.U. during the life of the mine must be approved by <br />the Division in consultation with the landowner or land management agency <br />having jurisdiction upon the meeting of the criteria in 4.16.3. <br />5. Snowmass must justify the retaining of roads in their P.M.L.U. plan. These <br />roads must be mapped relative to the final reclamation surface and must meet <br />applicable performance standards. <br />6. Since the proposed post mining land use for the prime farmlands is to leave <br />the road, the applicant must present legal justification for the requested <br />variance from 2.06.6(4)(a) vrhich states that prime farmlands must be reclaimed <br />to cropland. The applicant should also explain hour the proposed reclamation plan <br />vrould allow this Division to make the vrritten finding required by section <br />34-33-114(4)(a) of the Color°ado Surface Coal 1~1ine Reclamation Act. <br />Mitigation of the Impacts of Joining Operations <br />Air Pollution Control Plan <br />Section 2.05.6(1) - pane 159 and 174 . <br />1. The permit application must contain a copy(s) of all initially or finally <br />approved emission permits from the Colorado Air Quality Control Commission, <br />Air Pollution Control Division, or the air Quality Hearing Board. <br />2. The application must also contain copies of permits or applications and <br />relevent description of steps to be taken to comply vrith other applicable State <br />or Federal air quality laws or regulations. <br />2.05.6(2) Fish and wildlife Mitigation of Impacts Plan <br />1. l•lithout further fish and wildlife baseline information Snowmass' mitigation <br />plan cannot be evaluated at this time. <br />2. Snowmass needs to provide a discussion as to how the operator will minimize <br />disturbances and adverse impacts on fish and wildlife and related environmental <br />values (2.05.6(2)(a)(i)). This discussion should include the surface operations <br />and facilities and adjacent area as determined by the Division. <br />3. Snowmass needs to discuss at length their elk vrinter range improvement program. <br />
