This <br />correspondence follows your response received by the Division on July 2, 1997. <br />The following responses have been found adequate: <br />2, 3 ,13, 14, 16, 21, 23, 24, 25, 30, 37, 38, 44, 51, 69, 74, 84(a), 84(c)-Q), Fill 9 (a), 86, 98(b), 98(d), <br />98(f), 99, 100, 104, 107, 121, 122, 124, 137, 148(a), 148(b),148(c), 148(f), 148(1), Fill 8(I), 152, 164(Cow <br />to Rl), 167, 178, 186. <br />19. The applicant's response to this concern is inadequate. The response did not provide the <br />statement requested by the Division in its May 27, 1997 letter, pertaining to whether <br />Bruce Addington owns or controls, or within the period from 12/3 ] /91 - J 213 ] /96 owned <br />or controlled, any surface coal mining operation other than those listed as adequacy items <br />19.a. through 19.ii. <br />31. The Division has received two additional reports from Metcalf and Associates addressing <br />sites previously identified and /or sites in areas subject to disturbance as per the proposed <br />plan. <br />Sites SLA7012, SLA7007, and SLA7003 aze found within the disturbed area proposed <br />under the original plan for the coal loadout. These sites will not be disturbed since the <br />proposed location for the loadout has now been moved close to the mouth of Lorencito <br />Canyon. Cleazance for these sites has not been granted but is no longer necessary due to <br />the change in plans. <br />
