.(' I.~, <br />,)>%~ r II I I II I II I II IIII III ~`E,~ R~ ~4. ~., k~.. x ~;: 'i. ~ <br />s sss <br />AMENDMENT TO AGREEP.fENT <br />AND ASSIGNMENT OF OPERATING RIGHTS i:~'!' `'_} L%.~;' (iL-! ! ~••:.•.., ~.' <br />THIS AMENDMENT TO AGREE1,fENT AND ASSIGNMENT OF OPERATING <br />RIGHTS made and entered into by and between Atlantic Richfield <br />Company, a Pennsylvania corporation duly authorized and <br />qualified to do business in Colorado, whose address is 555 <br />Seventeenth Street, Denver, Colorado 80217, hereinafter <br />referred to as "Atlantic" and Bear Coal Company, Inc., a <br />Colorado corporation, whose address is Somerset, Colorado <br />81434, hereinafter referred to as "Operator" <br />W I T N E S S E T H: <br />WHEREAS, in order to assure that adequate coal resources <br />are available to the Operator during its term, the parties <br />hereto desire that that certain Agreement and Assignment of <br />Operating Rights executed February 2S, 1977 ("Agreement") be <br />hereby amended in certain respects, and <br />1SHEREAS, in order to provide such assurance it is <br />necessary to describe herein by governmental survey certain <br />additional lands under which Operator may mine the C coal <br />seam. <br />NON THEREFORE, in consideration of the mutual covenants <br /> <br />and conditions recited hereinafter, and other good and <br />valuable consideration, the receipt and sufficiency of which <br />are hereby acknowledged, the parties hereby agree and pro- <br />vide as follows: <br />1. That first Whereas Clause in said Agreement, as <br />well as that portion of Article I appearing on page 2 of <br />said Agreement shall be and is hereby amended only as to the <br />legal description to include the following additional lease <br />and lands in addition to the lease and lands previously <br />described therein, all in Gunnison County, Colorado: <br />~ li• .~ ~ • l., _.L <br /> <br />
