Rick Chilton -2- June 22, 1983 <br />Therefore, the Division requests in addition to the topsoil and subsoil <br />depth information submitted in the letter of June 20, 1983, the following: <br />1. Rock content, bulk density and water holding capacity calculations <br />for topsoil, subsoil and surficial colluvium (upper 2 feet). The <br />measurements should be obtained from at least 2 sites in <br />undisturbed orchard land adjacent to the disturbance. <br />2. A plan for measuring the same soil characteristics upon final <br />reclamation as a part of the post reclamation monitoring to <br />document restoration of the essential hydroloyic functions. <br />The remaining issues, presented below, have been discussed in recent <br />phone conversations with various representatives of Terror Creek Company, <br />and must be resolved prior to publication of the proposed decision. <br />1. Rule 2.07.6(2)(A)(V) specifically prohibits permit approval if the <br />proposed permit area is within 300 feet of an occupied dwelling, <br />"unless the owner thereof has provided a written waiver consenting <br />to surface coal mininy operations closer than 300 feet". <br />It appears from permit area maps that a number of residences are located <br />within 300 feet of the proposed permit area. The necessary waivers must <br />be provided to the Division. <br />2. The application does not contain a plan for non-coal waste removal, <br />storage, and disposal as required by Rules 2.05.3(8) and 4.11.4(1) <br />and (2). An acceptable plan must be provided. <br />3. Recent communication with Terror Creek rep res~~ntatives has <br />indicated that irriyation water at the site i<,~ diverted from the <br />Deer Trail ditch, not the Fire mountain Canal. This was not <br />'' clearly expressed in the application and the i~eer Trail Uitch is <br />not identified on the permit area maps. The relationship between <br />the Fire Mountain Canal and the Oeer Trail Ditch is not clear. A <br />permit area snap identifyiny the above ditches and a narrative <br />addressing the water source and general area irrigated by the Deer <br />Trail Ditch is requested. <br />4. The application does not contain a personal injury and property <br />damage insurance certificate as required by Rule 2.03.9. <br />
