handling and placement of high sodium spoils will not <br />be a problem with respect to post-mining ground water <br />quality. <br />Protection of Ground Water Recharge Capacity. <br />The proposed mining activities should have little adverse <br />impact on the recharge capacity of any identified aquifers. If <br />anything, the reclaimed spoils will be more permeable, thus <br />allowing a greater recharge of the Upper Sandy Member of the <br />Pierre Formation, the major aquifer and only source of water use <br />from an aquifer in the area of the mine. With respect to the <br />groundwater source for the alluvial sediments that will be <br />removed during mining, the recharge area occurs up dip from min- <br />ing on the nose and flanks of the anticline and is recharged <br />solely by precipitation events. It is anticipated that, because <br />the recharge area for these sediments is so small, once the site <br />is fully regraded, topsoiled and revegetated the subsurface com- <br />ponent should return over time to approximate pre-mining condi- <br />tions. The impact of mining these sediments on the recharge <br />capacity is therefore temporary and insignificant when the whole <br />subsurface regime is considered. <br />Water Rights and Replacement. <br />As discussed previously, only one registered well lies in or <br />near the mine plan area and is owned by Kerr Coal Co. Water <br />from the well (appropriation of 15 ac-ft./yr) is used for sanita- <br />tion purposes at the Kerr Mine. As unlike as it may be, in the <br />event that mining activities impact a groundwater quantity or <br />quality of the Kerr Well, the applicant should commit to replac- <br />ing the supply that is impacted.
