The applicant is in compliance, although <br />certain questions remain regarding reclamation of surfacing <br />materials (see comments in this section under Reclamation). <br />Maintenance <br />-~ The applicant has provided a description of road maintenance <br />~ (p. 35, Operations Plan), that includes blading, filling of pot <br />~~holes, resurfacing, and drainage ditch and culvert cleaning; the <br />applicant's description is in compliance. <br />Reclamation <br />~~ The applicant states that (except for 1,000 feet of present- <br />~ ,`1 ^ly detoured road) the haul road from Pit 2 to the crusher will <br />~rlot be reclaimed, as it provides access to the M&T oil well(p. <br />-F-~~~ 15, Addendum II of the permit application). The applicant needs <br />rr~,,///~. 3~~to obtain regulatory approval if any haul roads will remain after <br />IIL1 ~ cessation of mining operations. <br />In addition, the applicant states that "surfacing material <br />/,~ will be graded to blend with surrounding topography" (p. 9, <br />`-7i'' Addendum II). Section 4.03.1 (1)(b) of the Colorado Permanent <br />Regulatory Program specifically requires that surfacing material <br />be removed and disposed in accordance with Section 4.11.4, unless <br />otherwise authorized by the Division. The following stipulation <br />is therefore proposed: <br />The applicant shall request approval from the regula- <br />tory authorities for any roads that will not be <br />reclaimed and for road surfacing material that will <br />not be removed and disposed of following cessation of <br />mining operations. In addition, the applicant should <br />provide information showing that grading and blending <br />of road surfacing material with the surrounding mater- <br />ial will not adversely impact topsoil quality and <br />revegetation success. <br />-70- <br />
