• • li <br />Alternative 2: Disapproval <br />Disapproval of the mining and reclamation plan) could be con- <br />sidered as an option, particularly because of deficiencies in the <br />backfilling and grading plan which will potentially impact recla- <br />mation and bonding. Disapproval, however, wound eliminate the <br />recovery of a valuable resource and result in the unemployment of <br />personnel currently employed at the mine.A modifiled form of dis- <br />approval, rejection of the MRP with provisions for resubmittal, <br />could potentially have the same results as disapproval if a sig- <br />nificant amount of time elapsed before the perimit application <br />could be reconsidered. In the present situationl, the applicant <br />must receive a permit approval within the near future in order to <br />continue mining.. If this option is chosen on the basis of defic- <br />iencies encountered in the present application, the potential for <br />emergency extensions will have to be investigated if mining at <br />the site is to continue. <br />Alternative 3: No Action <br />OSM must recommend an action on a mining and reclamation plan <br />because the Federal mineral leasing laws and the existing lease <br />agreement require the Secretary of the Interior to respond to an <br />application to mine and conduct operations on a Federal lease. <br />Wyoming Fuel Company has met all the requirements of the lease to <br />the best of our knowledge. Similarly, the Colorado Mined Land <br />Reclamation Board isorequired to take action on a permit applica- <br />tion by virtue of statutary deadlines implicit in the Colorado <br />Surface Coal Mining Reclamation Act. <br />Alternative 4: Approval with Modifications <br />Alternatives to various aspects of the proposed miming and recla- <br />mation plan may either mitigate impacts associated with the oper- <br />ation or create new impacts.
