<br />-2- <br />tons of coal will be produced during Phase A, resulting in a projected 12,000 <br />tons of coal processing waste. The applicant proposes to store the coal <br />processing waste in a temporary stockpile to measure 380 feet long by 115 feet <br />wide by 12 feet high. Side slopes will not exceed a gradient of 3:1 <br />(horizontal to vertical slope). The stockpiles location is depicted on Figure <br />4.2-7A. <br />In order to assure timely approval of the eventual Phase B coal processing <br />waste slurry embankment, the Division deems it appropriate to impose the <br />following stipulation upon permit approval for Phase A of the proposed <br />operations. <br />STIPULATION: <br />THE DIVISION REQUIRES THAT STORM KING MINING COMPLETE AN APPROVABLE "DETAILED <br />ENGINEERING PLAN" FOR THE PERMANENT PHASE B WASTE SLURRY EMBANKMENT WITHIN ONE <br />YEAR FOLLOWING ISSUANCE OF THE PERMIT. FURTHER, IF 12,000 TONS OF WASTE IS <br />PRODUCED PRIOR TO OBTAINING APPROVAL OF THE PERMANENT WASTE EMBANKMENT, MINING <br />OPERATIONS SHALL CEASE UNTIL AN APPROVAL IS OBTAINED FOR PERMANENT DISPOSAL OF <br />ADDITIONAL WASTE. <br />Rule 2.05.6(6) Subsidence <br />In response to comments included within the Division's original adequacy <br />review, the applicant's consultant, Subsidence Engineering, Inc., has <br />completed significant amendment of the original application's Appendix 4.5-1. <br />The consultant amended Appendix 4.5-1 to discuss the mechanisms controlling <br />the character of roof strata failure. The amended text contains a specific <br />discussion of anticipated gob movements in relation to bedrock dip. The <br />consultant observes that a slight possibility exists for sinkhole collapse to <br />occur near the outcrop crown pillar. The amended application proposes a <br />specific visual monitoring program to concentrate in areas over and adjacent <br />to the crown pillar, in order to specifically detect potential sinkhole <br />collapse (page 41.4). The amended application also presents a proposed <br />mitigative program for sinkhole collapse, were it to occur. On page 43.3 of <br />amended Appendix 4.5-1 the consultant proposes that Storm King Mining restrict <br />access to any areas of sinkhole collapse and that appropriate amendments be <br />made to the mine plan. The Division believes it prudent, in order to assure <br />protection of the Public health and safety to impose the following stipulation <br />upon permit approval. <br />STIPULATION: <br />THE DIVISION REQUIRES STORM KING MINING, IN THE EVENT THAT SINKHOLE SUBSIDENCE <br />COLLAPSE WERE DETERMINED, BY THE DIVISION, TO CONSTITUTE A POTENTIAL HAZARD TO <br />THE PUBLIC HEALTH AND SAFETY, TO IMPLEMENT APPROPRIATE SEALING AND BACKFILLING <br />OF SINKHOLE COLLAPSE FEATURES. <br />
