The water diversion and sediment control system is to be constructed
according to the plan and designs submitted to the Division on April 14,
1982. These plans and designs will meet the Division's standards
according to Rule 2.05.3(4) with the following stipulations.
1. The operator should install a percent sediment storage staff gage
in the pond.
2. A trash rack or deflector should be placed at the entrance of the
road culvert. This trash rack should not be flush with the culvert inlet,
rather it should be sloped or extended in front of the culvert. Rough
designs on this device should be submitted to the Division for approval
prior to installation.
3. The dewatering pipe and anti-seep collars must be installed with a
high degree of care. Native materials, with large cobbles removed, or
a suitable clay material should be used to fill in around the de~oatering
pipe and be appropriately compacted.
4. An anal}•sis of the material to be used for constructing the pond
embankment should be completed to determine suitability. Tliis informalion
should then be used by the design engineer to make any appropriate changes
in the construction plans for the embankment. The embankment shall then
be constructed according to the amended design plans, including compaction and
material specifica*_ions.
5. A professional engineer must inspect and supervise embankment construction,
and must certify that the dewatering pipe has been properly installed, and
that the embankment meets the requirements of Rule 4.05.6(8). A statement
describing the compaction rate achieved and permeability characteristics
of the embankment must be sent to the Division along with the above
certification immediately following construction.
The Division~is not approving at this time, the retention of this pond after
reclamation. Hocaever, this request will be handled through the permit
revieco process.
There are also concerns about the stability of the mine bench. Therefore
the Division is directing Sundance Coal Company, Inc. to submit a mitigation
plan to stabilize the mine bench in accordance with Rule 4.09. This plan
should be submitted as soon as possible.
Please feel free to call if you have any questions.
Sincerely,
r
Susan Mocary ~~ l
Reclamation Specialist
Sit: ep
cc: Greg Lecuicki
