The water diversion and sediment control system is to be constructed <br />according to the plan and designs submitted to the Division on April 14, <br />1982. These plans and designs will meet the Division's standards <br />according to Rule 2.05.3(4) with the following stipulations. <br />1. The operator should install a percent sediment storage staff gage <br />in the pond. <br />2. A trash rack or deflector should be placed at the entrance of the <br />road culvert. This trash rack should not be flush with the culvert inlet, <br />rather it should be sloped or extended in front of the culvert. Rough <br />designs on this device should be submitted to the Division for approval <br />prior to installation. <br />3. The dewatering pipe and anti-seep collars must be installed with a <br />high degree of care. Native materials, with large cobbles removed, or <br />a suitable clay material should be used to fill in around the de~oatering <br />pipe and be appropriately compacted. <br />4. An anal}•sis of the material to be used for constructing the pond <br />embankment should be completed to determine suitability. Tliis informalion <br />should then be used by the design engineer to make any appropriate changes <br />in the construction plans for the embankment. The embankment shall then <br />be constructed according to the amended design plans, including compaction and <br />material specifica*_ions. <br />5. A professional engineer must inspect and supervise embankment construction, <br />and must certify that the dewatering pipe has been properly installed, and <br />that the embankment meets the requirements of Rule 4.05.6(8). A statement <br />describing the compaction rate achieved and permeability characteristics <br />of the embankment must be sent to the Division along with the above <br />certification immediately following construction. <br />The Division~is not approving at this time, the retention of this pond after <br />reclamation. Hocaever, this request will be handled through the permit <br />revieco process. <br />There are also concerns about the stability of the mine bench. Therefore <br />the Division is directing Sundance Coal Company, Inc. to submit a mitigation <br />plan to stabilize the mine bench in accordance with Rule 4.09.
