I am writing this letter to define what we understand <br />as items requiring a further response. If this list of items is <br />incomplete or incorrect, please advise. Otherwise, we will set <br />March 9, 1984 as a target date to have submitted to you the supple- <br />mental information. <br />Item I. We have the Delta County public file copy available for <br />review in our Delta office. You inquired as to why we are using our <br />own office, rather than the courthouse for the public filing location. <br />Our understanding was that the Delta County Courthouse will keep <br />copies available to the public for only thirty days, and then wi]1 <br />have them either picked up or destroyed. Since this time frame is <br />obviously not acceptable to MLR, we offered to create a public file <br />copy shelf in our own office. This procedure had been accepted for <br />another mine operation, and we assume that it is the proper way to <br />handle the public file copy of our permit application. <br />Item II. You advised us that Rad Orell at the Denver Office of <br />Surface Mining location would be the new contact on Grand P1esa Coal <br />Company permit matters. We will use Mr. Orell as the contact, effec- <br />tive today. <br />Item III. It is our understanding that you are not satisfied <br />with the description of the Grand Mesa Coal Company loadout as it <br />presently exists in the application. We will eliminate your concern <br />by providing a meet and bounds description of the entire loadout. <br />Item IV. You commented that the legal description of the permit <br />area is now out of date. We will revise it and provide you with the <br />updated legal description for the permit area, including the boundary <br />for five years of mining, the adjacent area included due to angle of <br />draw, and the Delta loadout site. <br /> <br />
