Furthermore, were the road <br />per-se be unable to completely divert undisturbed runoff <br />away from our disturbed area, the resultant failure would <br />merely add to the inflow of the settling pond. The settling <br />pond has adequate excess capacity. This was demonstrated <br />earlier this year, when a 2" rainfall event failed to fill <br />the pond even to the point of dewatering overflow. Since <br />the hydrologic protection need only function to the 10 year <br />event, it certainly seems likely that additional inflow <br />could be legally accommodated. <br />We are an underground mining operation. The surface <br />excavation equipment which we own is limited to loaders and <br />a backhoe. Ditch D-7, as it exists now, required a considerable <br />amount of work. Blasting was required in several sections <br />so we could excavate the ditch. This necessitated the trans- <br />portation of several ancillary pieces of construction equip- <br />ment including an air compressor and drill. <br />Although it is true that the road was nearly free of <br />snow at the time of your last inspection, it was still quite <br />muddy. Presently, there is about 10 to 12 inches of snow on <br />the road. Because of the amount of work necessary to construct <br />(or enlarge) ditch D-7 under the confines of physical conditions, <br />a "window" of. at least two weeks of good weather with a dry <br />and snow-free roadbed would be required to undertake ditch <br />construction. There is no way such a construction job could <br />be completed prior to February 1. <br />At the time of spring thaw, we will (with your consent), <br />walk the road and repair (by hand - with shovels) any portion <br />of the outside road-edge berm breached by runoff so the <br />undisturbed runoff remains on the road surface and is precluded <br />from reaching the settling pond. <br />Yours tru , <br />f` r <br />`~ « ~ ~~~ <br />David R.
