r` - ~` <br />III IIIIIIIIIIIII III <br />999 <br />n E c 2 ~ i9s~ <br />December 21, 1981 <br />Mrs. Carol Russell <br />Mined Land Reclamation <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203. <br />Dear Mrs. Russell, <br />~ ~.. <br />~ (.mot-_. ,.. t' ., ... <br /> <br />The following comments represent our response to the <br />Mined Land Reclamation inspection report for 9 December <br />1981. <br />The diversion ditch above the hillside containing the <br />portals (D-7) is on the inside edge of a ranch access road. <br />This road is entirely outside of our surface-facilities dis- <br />turbed area. Along several portions of this road (most <br />notably those sections where the ditch depth is shallow) the <br />road has been excavated from solid sandstone outcroppings. <br />Due to the extreme slope of the hillside; the ranch road's <br />close horizontal proximity to the portal highwall cut; and <br />the aforementioned predominance of massive sandstone crops, <br />any widening of this road would amount to a monumental under- <br />taking (if not an impossible task). The net result of these <br />conditions (which, with the exception of ditch D-7 per se, <br />existed as-is prior to current regulatory prohibition) is <br />that any widening of ditch D-7 would result in the direct <br />reduction of usable roadbed width. Inasmuch as the use of, <br />and the ownership and right-of-way easements on this road <br />are vested entirely removed from Sunland Mining Corporation, <br />our Corporation would be in very poor legal posture were it <br />to disrupt the usability of the road. <br />The input of the ranch road to the hydrologic protection <br />associated with our mining operation is solely to divert <br />undisturbed runoff directly to the natural drainage without <br />benefit(?) of sediment pond detention. It seems highly likely <br />that the road would provide this function (as it had for 80 <br />years or so, prior to our construction of ditch D-7) with or <br />SUNLAND /MINING CORPORATION <br />P.O.
