Box 774288 <br />Steamboat Springs, Colorado 60477 <br />RE: Energy Mine No. 3 <br />Dear Mr. McMlndes: <br />The purpose of this letter is two-fold. The first 15 to discuss this year's <br />proposed reclamation at Energy Mine No. 3 and the second is to address the <br />major topics we discussed 1n our March 16, 184 meeting regarding the adequacy <br />review. As you know the Division 1s concerned about reclamation activities at <br />the Energy No. 3 Mine and we do not want the permitting process to delay <br />reclamation. There is not a current approved reclamation plan for the Energy <br />No. 3 Mine. <br />After our meeting on March 16, 1984 discussing the adequacy review on Energy <br />Mine No. 3 it became apparent that it could be several months until a permit <br />is issued. Colorado Yampa Coal Company indicated that the earliest response <br />to the adequacy letter would be submitted in late April. Because we do not <br />have a current reclamation plan the Division is concerned about reclamation <br />activities proposed for 1984. Reclamation activities cannot begin until they <br />have been approved, 1n advance by the Division. Therefore, if CYCC is <br />proposing to begin reclamation operations before a permit 1s issued a <br />reclamation plan will need to be submitted. <br />The reclamation schedule 1n the permit application states that Colorado Yampa <br />Coal Company will complete topsoil redistribution and plant the perennial seed <br />mixture on the permanent overburden stockpile, final grade, topsoil, and <br />revegetate the entire affected area south of County Road 33, with the <br />exception of the Middle Creek Office area, haulroad corridor, and proposed <br />surface mining area. Additionally, in our meeting on March 28, 1984 you <br />stated that Colorado Yampa Coal Company 1s proposing to place 100,000 yd3 of <br />material in the Energy No. 3 detention basin this year. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
