The mean size is approximately <br />1.25 feet in diameter. <br />(9.~ Regarc9ing point 8 made by AN[~ BALDRIGE: The Eastern diversion ditch as <br />located on the map will not encounter and access road. It wi]_1 route water away <br />from the mine bench and distribute it onto the slope leading to the meadow. This <br />will accomplish the diversion needed and place the water onto a natural r,.moff <br />situation. The S.C.S, has stated that the Zau Stony Loam soil type around the mine <br />bench retains a high volume of water in the topsoil. 'T'herefore, rerouting the water <br />in this way will promote growth within the vegetation cortmunity on the Fastern side <br />of the mine by allowing the water to return to the slope instead of diverting the <br />water down along the access road. See Mine Surface and Hydrology Map (Map #1). <br />BLUE FLAME COAL MINE forsees no possible impacts of any nature due to this diversion <br />program. The diversion ditch is designed to slope at 2 to 3 degrees. This pitch <br />will minimize water velocity and the risk of any erosion. <br />(T0) I have enclosed a map entitled "Mine Surface and Hydrology Map" (Map #1) <br />that has been amended to meet the requirements of Rule 2.04.5 and 2.04.7. <br />(1~) Map #1 has been revised to show the position of the topsoil stockpile. <br />2.04.11 FISH AND WILDLIFE RESOURSE INFORMATION <br />BLUE FLAME COAL MINE has requested from the Division of Wildlife a Fish and <br />Wildlife Resourse Study, by filing the appropriate paperwork with the Division of <br />Wildlife. They have informed me that it will take some time to process the paper- <br />work and respond to our request. When that information becomes available to BLUE <br />FLAME COAL MINE, we will timely forwarr3 copies of the docimients to you as will the <br />Division of Wildlife. <br />~~ 2.04.12 PRIME FARMLAND INVESTIGATION <br />(1) The Division is correct in understanding that the coal to be mined is <br />privately owned by MR. FIDEL LOBATO. The sentence "the private surface overlying <br />the proposed new Federal coal lease contains no farmland" was mistakenly included <br />in the paragraph. The paragraph should read the surface area (permit area) of <br />the BLUE FLAME COAL MINE contains no prime farmland, the private surface overlaying <br />the underground mine works contain no prime farmland". The sentence eluded to in <br />the Adequacy Review Letter #2 has been removed from the paragraph. <br />(2) Pursuant to Rule 2.04.12 paragraph 3, BLUE FLAME COAL MINE submits a re- <br />quest for a negative determination which concludes that the land meets one of the <br />criteria of 2.04.12, paragraph 2. This land shall not be considered prime farm- <br />land, whereby BLUE FLAME COAL MINE demonstrates that (a) the land has not been <br />historically used as crop land, (b) the land is not irrigated or naturally sub- <br />i.rri.gated, has no developed water supply that is dependable or of adequate <br />quality. (c) on the basis of a soil survey of the lands within the permit area <br />there are no soil map units that have been designated prime farmland by the U. S. <br />
