Pursuant to Rule 7, designating areas unsuitable for surface coal mining, of
the Regulations of the Colorado Mined Land Reclamation Board for Coa) Mining, I am
requesting that my 35 acre lot in the Chandler Heights Subdivision, Williamsburg, CO
be designated as unsuitable for all types of coal mining.
2. Chandler Heights Subdivision, Lot 1, 35.24 acres
SE1/4, Section 24 South, T95, R70W, 6"' PM
Surface owners: Gary W. Zak and Karen R. Zak
Mineral interests owners: Chandler Creek Companies,
PO Box 37286, Denver, CO 80237
4. We are petitioning the Board to designate as unsuitable for all types of coal
mining my 35.24 acre parcel of land; now and in the future. Currently, our property is
part a mine permit area for an underground coal mine proposed by Northfield Mine,
Permit No. C-2006-085. (See enclosed Mine Map 7) The following are our concerns:
1. Safety: (substantially endanger life and property) Northfield Mine plans to mine
coal under 4-5 acres of our property. Very near the surface of this portion of the
mine is a Giff face and balancing rocks. Another 5-6 acres of our property beyond
that is in the 25-degree draw down area. If the ground near the cliff face is
subsided by 4-5 feet it may well cause the cliff face to collapse, but at a minimum k
would cause cracks to form in it, followed possibly by shifting, which could cause
some of the balancing rocks to fall. The affect of the subsidence on this natural
hazard area and unstable geology could substantially endanger Irfe and property.
This would make a large portion of our property and even County Road 79 unsafe.
To the best of our knowledge Northfield Mine has not addressed this surface land
safety issue with the Division of Recamation, Mining, and Safety. (Enclosed are
pictures of the area to be subsided and a Google Earth printout of our property.)
2. Environment: (adversely affect fragile lands) The Northfield Mine Project will
change the environment for not only my wife and me, but also a large portion of
the Chandler Heights subdivision. We chose this place to live for its location and
the beauty of the land. We do not want our cliff face changed in any way, nor one
rock moved on our property due to mining operations. We bought our 35 acres to
