<br />-z- <br />2) The applicant must conduct and receive Division approval of a <br />structural and foundation analysis to establish design standards for <br />embankment stability for the access road. The analysis shall be <br />conducted in conformance with rule 4.03.1(3)(d)(vii). <br />3) The applicant must submit the information required by Rule 4.05.3 for <br />the existing light-use roads used to access monitoring facilities. If <br />any of these roads are not in compliance with Rule 4.03.3, a plan to <br />bring them into compliance must be submitted. <br />Coal Processing and Non-Coal Processing Waste -Rule 2.05.3(8) <br />The Division does not believe it appropriate to permit mining of coal <br />without an approved coal processing waste disposal structure. The applicant <br />has at least two alternatives in obtaining a permit for a coal processing <br />waste disposal area: 1) the applicant can submit a general plan with a <br />certified schedule for completion of the detailed plan; or 2} the applicant <br />could pursue phased approval of a coal processing waste disposal area. <br />To receive approval of a general plan, the applicant must: 1) amend the <br />engineered design to achieve a seismic safety factor of at least 1.2; 2) <br />submit a certified schedule for submission of detailed designs prior to mining <br />any coal; and 3) submit a certification statement, prepared by Chen and <br />Associates, that the report contained in Appendix 3.3-3a, as amended, is still <br />certified by Chen and Associates. <br />Phased approval of the pile would require the submission of a detailed plan <br />for a small initial coal processing waste pile with a low facial slope angle <br />which could easily be demonstrated to achieve the appropriate seismic slope <br />safety factor. Subsequent detailed plans can then be submitted for each phase <br />of the pile construction. <br />Bonding - Rule 2.05.4(2)(b) and Rule 3 <br />1) The applicant did not include the cost of removing the trailers, <br />sediment pond removal, drainage ditch removal, and revegetation costs. <br />In addition, it is not apparent whether the equipment rental rates <br />include operating costs. The above information must be submitted. <br />~ Operations on Lands Subject to Limitations or Prohibitions -Rules 2.07.6 <br />.
