Box 229 <br />Boulder, Colorado 80306 <br />Dear Scott: <br />This Letter will serve to summarize the items we discussed with yourself <br />and Walt Ayers in our November 3, 1981 meeting. <br />Rich Domingue was introduced as one of the future MLR inspectors of the Bourg <br />Strip mine. MLR inspections will continue on a monthly basis with myself <br />inspecting on odd months (November, January, Pfarch, etc.) and Rich Domingue <br />inspecting on even months (December, February, April, etc.). I will retain <br />primary responsibility for agency contact and coordination, and permit review. <br />The status of the review of the Bourg permanent program permit submission was <br />discussed. Bourg has submitted some of the information requested in the P1LR <br />preliminary adequacy review. The remainder of the material requested in the <br />P.A.R. will be submitted to the Division on or before the end of November. <br />As this material is received, the Division will he gin drafting findings, and <br />the technical analysis of the submitted information. In the technical analysis <br />phase, the Division anticipates working closely with Flatiron to resolve as <br />many issues as possible. The Division anticipates that the permitting process <br />should be in the final negotiation phase in late December, 1981 and January, <br />1982. <br />Several concerns relating to potential or actual on-the-ground compliance at <br />the mine site were discussed. Flatiron clarified the situation relative <br />to preparations for construction of the permanent East Dump. The Division is <br />still requiring a certified Colorado professional engineer to supervise the <br />construction as outlined in pages 8R (A) and 8R(B) of the approved interim permit. <br />The sediment control system and facilities at the mine site have caused concern <br />over the last year. Flatiron stated that the system, as proposed in the permanent <br />program application, is the system that they wish to be instituted at this time. <br />The Division is reviewing the system currently, with the direction of working <br />with Flatiron to bring the entire system into compliance as soon as possible. <br />
