<br />and-fill reclamation of the 1350-foot long initial cut. This is necessary to provide for the <br />initial cut's reclamation in the event the southern ridge isn't mined, and spoil from the <br />northern ridge is insufficient to backfill the cut due to its placement in excess spoil fills <br />or in the backfill of the northern ridge's reclamation. <br />69. The applicant's response states "The berm will be a minimum of 15 feet wide from the <br />outcrop, in areas not bounded by the outcrop". What will the bean's height be? What <br />does "in areas not bounded by fills" mean? Are these the areas on the reclaimed <br />hillslopes between the excess spoil piles, or the areas overlain by the spoil piles, or the <br />areas above the tops of the proposed spoil piles? Areas of fill between the spoil piles <br />would still need the berm. <br />72. The applicant's response is inadequate. The Division requests the applicant provide a <br />copy of the plan approved by MSHA for the storage and/or disposal of coal mine waste <br />into abandoned workings. This plan should have included the elements described in <br />Section 2.05.3(a) of the Board's Regulations. <br />Rule 2.05.3(3) Mine Facilities <br />Under this section, all responses were found adequate except as listed below. <br />73. The applicant's response is inadequate. First, the applicant should add a few words to the <br />"Loadout Facility" section of the application (application page 2.05-30) to include the <br />breaker facility. Figure 2.05.3-IS should also be revised to include the breaker facility. <br />Second, the applicant acknowledges in its response that coal processing waste will be <br />generated at this Loadout breaker facility. As such, designs for a processing coal waste <br />bank, developed in accordance with Section 4.10, must be provided at this time. The <br />Division cannot approve an application for an operation that proposes to generate coal <br />processing waste without approving plans for the disposal and reclamation of that waste. <br />74. Figures 2.05.3-5 to 7 were not found in the revised materials submitted. <br />75. The maps referenced and the text pages cited do not seem to make sense. Please review <br />and correct as necessary. <br />76. It is uncleaz from Map 19-1 in Exhibit 19 how disturbed area drainage from die Loadout <br />azea on the north west side of the railroad spur will make it to the sediment pond on the <br />southeast side of the spur. Should some culverts be installed under the spur neaz the <br />Loadout to accomplish this? <br />78. The applicant's response is inadequate. The Division requested the applicant provide the <br />designs for the construction of all buildings planned to be constructed with concrete floors <br />(Section 2.05.3(3)(a) of the Board's Regulations). The applicant responded that "a new <br />Figure 2.05.3-46 provides the fuel and water tank foundation design". <br />
