Mike Long <br />Page 11 <br />4. We agreed to discuss the concerns of this part at <br />a later date in order to provide the Division time <br />to review our response to the issues. The attachment <br />hereto discusses the concerns in part. <br />Further, as I indicated during our meeting, <br />pasture land areas with similar soil type, elevation, <br />aspect, precipitation patterns and species composition <br />do not exist in the area of the mine. In addition, <br />the portions of the regulations which discuss the <br />use of reference areas do not specifically address <br />use of such areas for changes in the post-mining <br />land use other than cropland. Pasture land does <br />not fall under the definition of cropland. Therefore, <br />it does not appear that the establishment of <br />success criteria in this instance is easily obtainable <br />nor realistic in terms of obtaining a viable <br />comparison. <br />5. The drill holes depicted on the Geology Map will <br />be mined through either during the term of the <br />present permit application or through the term of <br />successive permits. Water wells utilized as <br />ground water monitoring consist of domestic deep <br />wells and shallow alluvial valley floor wells. <br />The domestic wells will obviously remain in tact <br />upon the cessation of operations while the shallow <br />wells will be removed. If actual removal of the <br />wells is not possible, the cases will be backfilled <br />with bentonite and the well heads will be removed. <br />Section 2.05.5 Post-Mining Land Uses <br />1. As we discussed in your office, the 2 inches of <br />topsoil replacement is a minimum depth. In instances <br />where more topsoil is available, above the average <br />depths previously discussed, more will be replaced. <br />In addition, 4 inches of subsoil will be replaced. <br />The subsoil is not without constituents capable of <br />aiding vegetative growth. Amendments, as needed, <br />will also be applied to the area. Further, as you <br />are aware, similar sites are not available and <br />sufficient area at the mine site does not exist to <br />construct test plots. In addition, we are committed <br />to establish adequately reclaimed land in the <br />mined out areas. Not to do so may subject the <br />company to loss of bond and effect obtaining <br />future permits. Therefore, we are bound to ensure <br />adequate reclamation in accordance with the terms <br />of the permit as it is approved. <br /> <br />
