u <br />' • , r <br />~ ~-~ <br />• I ; <br />n~ <br />_ I~~u~ <br />Section 2.03.5 Compliance Information ~~~ <br />(1) A statement of whether the applicant, any subsidiary, affiliate, <br />of persons controlled by or under common control with the applicant <br />has: <br />Neither applicant, any subsidiary, affiliate, or persons controlled <br />by or under common control with the applicant has: <br />(a) Had a Federal or State Mining permit for surface coal <br />mining operations suspended or revoked in the last five years <br />prior to the date of submission of the application; or <br />(b) Forfeited a mining bond or similar security deposited in <br />lieu of bond. <br />The applicant and the entities described in Paragraph 2.03.4 <br />above have not had a Federal or State surface coal mining <br />permit suspended in the last five years, nor has there <br />been a forfeiture of security during that period. <br />(2) A statement of the facts involved, if such suspension, revocation, <br />or forfeiture has occurred. <br />Not Applicable <br />(3) A listing of each violation notice received by the applicant in <br />connection with any surface coal mining operation during the 3-year <br />period before the application date, for violations of any applicable <br />law, rule, regulation of the United States, or of any Colorado law, <br />rule, or regulation enacted pursuant to Federal law, rule, or regulation, <br />or of any provision of the Act, pertaining to air or water environmental <br />protection. <br />Notice of Vio]ation Information: The Applicant has received <br />five (5) violation notices. <br />1. Notice of Violation 79-V-5-13 <br />a. June 21, 1979; Office of Surface Mining Reclamation and <br />Enforcement <br />b. Lack of sediment control within the mine property <br />c. On July 18, 1979 an assessment worksheet was sent to the <br />operator by the Office of Surface Mining Reclamation and <br />Enforcement <br />REVISED November 1, 1983 21 <br />
