Section 2.03.5 Compliance Information ~~~
(1) A statement of whether the applicant, any subsidiary, affiliate,
of persons controlled by or under common control with the applicant
has:
Neither applicant, any subsidiary, affiliate, or persons controlled
by or under common control with the applicant has:
(a) Had a Federal or State Mining permit for surface coal
mining operations suspended or revoked in the last five years
prior to the date of submission of the application; or
(b) Forfeited a mining bond or similar security deposited in
lieu of bond.
The applicant and the entities described in Paragraph 2.03.4
above have not had a Federal or State surface coal mining
permit suspended in the last five years, nor has there
been a forfeiture of security during that period.
(2) A statement of the facts involved, if such suspension, revocation,
or forfeiture has occurred.

(3) A listing of each violation notice received by the applicant in
connection with any surface coal mining operation during the 3-year
period before the application date, for violations of any applicable
law, rule, regulation of the United States, or of any Colorado law,
rule, or regulation enacted pursuant to Federal law, rule, or regulation,
or of any provision of the Act, pertaining to air or water environmental
protection.

five (5) violation notices.

b. Lack of sediment control within the mine property
c. On July 18, 1979 an assessment worksheet was sent to the
operator by the Office of Surface Mining Reclamation and
Enforcement
