<br />must be therefore revised in the following manner to fully implement the applicant's latest <br />wishes: (a) all references to the coal loadout breaker must be removed from the application; <br />(b) all references to coal processing occurring at the loadout or in the surface mine must be <br />removed from the application; (c) a map prepared to a scale of 1 inch to 500 feet (1:6000) <br />showing the location and orientation of the proposed waste bank must be submitted (Rules <br />2.05.3(8)(a)(I)(B) and 2.10.1(1)). This map must be certified (Rule 2.10.3(2)); (d) the <br />currently-submitted plans and drawings for the waste bank do not appear to have been <br />prepared by, or under the direction of, a registered professional engineer, and if fact have not <br />been, must be, before the Division may approve them; (e) information addressing the <br />reyuirements of Rules 2.05.3(8)(a)(I)(C), (D) and (E) must be supplied; (f) information <br />addressing the requirements of Rule 2.05.3(8)(a)(ii) must be supplied; (g) information <br />pertaining to what the maximum dry density of the coal waste is expected to be (Rule <br />4.10.4(3)) must be supplied; (h) a demonstration that the proposed construction of the waste <br />bank will achieve a minimum static safety factor of 1.5 (Rule 4.10.4(2)) must be supplied; (i) <br />plans for upland diversions and bank surface runoff collection systems (Rule 4.10.3(2)) must <br />be supplied. <br />Until this information is submitted to, and reviewed and approved by, the Division, the <br />application cannot be approved to include an underground mine development waste bank as <br />part of the proposed mine activities. <br />74. This question has been adequately addressed. <br />75. The applicant's response is inadequate. The applicant states that proposed substation <br />transformers (plural) are located on Map 2.05.3-1. They are not. Further, revised page 2.05- <br />13 (6/30/97) refers to a single transformer pad. Please identify the locations of all planned <br />substations on Map 2.05.3-1, and revise the permit text if more than one pad is planned. <br />76. The Division initially requested for engineering plans and drawings for the railroad spur. <br />The applicant responded that these were located in Exhibit 19. The Division reviewed <br />Exhibit 19, and subsequently asked how disturbed area drainage from the loadout areas on <br />the northwest side of the spur would be routed for treatment to the sediment pond to the <br />southeast of the pond, as no culverts under the spur in the area of the loadout were indicated. <br />The applicant responded that it was in the process of designing 25-yeaz, 24-hour temporary <br />impoundments on the west side of the spur near the loadout to address this matter. As there <br />designs have yet to be submitted, the response to this question is still inadequate. <br />78. The applicant has adequately addressed this question; however, there appeazs to be a <br />discrepancy in the text of page 2.05-13 (revised 6/30/97). In the fourth sentence, it is <br />indicated that a bath house will be located a[ each of the three figures (this is supported by <br />Figure 2.05.3-5 through 2.05.3-7). However, the sixth sentence states "LCC proposes not to <br />have bath house facilities...". Will LCC use bath houses or no['? <br />9l. The Division initially asked for five sets of information pertaining to each of the nine <br />proposed valley/head-of-hollow fills (Mazch 3, 1997). The applicant's initial response was <br />
