Page Ten <br />Preliminary Adequacy Review <br />GEX - Roadside 6 Cameo Mines <br />April 27, 1981 <br />3. Scope of Exemption <br />Surface coal mining operations conducted within the geographic extent <br />of an exemption are not required to comply with the requirements of Section <br />114(2)(e)(I). However, the mining operations must meet all of the remaining <br />requirements of the Act regarding protection of the hydrologic balance. <br />Exempted operations must therefore, satisfy the requirements of Section <br />ll4(2)(c), 121(2)(1), any related performance requirements of Section 121, <br />and as required 121(2)(j), the appropriate requirements of 120(2)(j). <br />The requirements that must be satisfied include the performance standard <br />for R13uviaZ Valley Floows(120(2)(j)(VI)). <br />Non-exempted operations, i.e., those surface coal mining operations not <br />conducted within the specific geographic area of exemption, must satisfy <br />the requirements of Section 114(2)(c), Section 121(2)(1), any related <br />performance standard requirements of Section 121, the appropriate requirements <br />of 120(2)(j) AND the requirements of Section 114(2)(e)(I). <br />4. Information Required <br />The alluvial valley floor exemption is very complicated for underground <br />mines, and it may take a while to determine the geographical extent of the <br />lands eligible for the exemption.: Since all Alluvial Valley Floor issues <br />must be resolved prior to the permit issuing, the applicant should supply <br />the requested information as soon as possible. The existence of an alluvial <br />valley floor, adjacent to or within an area eligible for exemption would <br />not prohibit mining (as could be required under 114(2)(e)(I)), but the <br />essential hydrologic functions must be restored (120(2)(j)(VI)), or the <br />applicant would have to prove the mining operation would not significantly <br />affect the AVF. <br />The applicant has two courses of action: It can concede that the areas <br />mapped as unconsolidated stream-laid deposits are an AVF or submit a <br />reconnaissance level RVF investigation. <br />The reconnaissance level alluvial valley floor investigation should provide <br />the following information, including all supporting data, assumptions, and <br />methods of determination: <br />1. A map showing the location of aI1 unconsolidated stream-laid deposits. <br />Include the present flood plain and ALL associated terraces. Only high <br />isolated terraces may be excluded from the determination. (Map on USGS 7-I/2 <br />minute quad.). This mapping has already been done by the applicant, but <br />mapping of all the required information should be done on one map. <br />2. Identify on the map, the permit area, the Life-of-mine area, and the <br />reconnaissance study area. <br />3. On that same map show all areas of existing or historic flood irrigation. <br />
