<br />/ Mr. Derry Ferguson - 2 - June 21, 1993 <br />~~ ~ 2.03.3 - Format and Supplemental Information: The applicant has failed to <br />II respond to Sections 2.03.3(3) and 2.03.3(4), as shown on page 3-1 of the <br />^~ l application. There should be committments by the applicant to comply <br />( 6' with these Rules. <br />2.03.3(5) has been mislabelled 2.03.3(4). So have 2.03.3(5) (should be <br />2.03.3(6)), 2.03.3(6) (should be 2.03.3(7)), 2.03.3(7) (should be <br />2.03.3(8)), and 2.03.3(8) (should be 2.03.3(9)). <br />7. Rule 2.03.3(7) requires names, addresses and positions of officials of <br />M the agencies or individuals that provided information on land use, soils, <br />ill ~~( geology, vegetation, fish and wildlife, water quantity and quality, air <br />~ ~~(- quality, and archeaological, cultural and historic features. The only <br />~tid persons identified under this section of the application were one <br />Division of Water Resources employee and one Water Quality Control <br />Division employee. The applicant needs to identify people who helped on <br />land use, soils, vegetation, air quality, fish and wildlife, and <br />historical items. <br />Rule 2.03.3(8) requires the applicant to send copies of the application <br />~ to OSM if there is Federal Coal proposed to be mined. Applicant states <br />on page 3-3, in paragraph 2.03.3(7) (Mistakenly - should be 2.03.3(8)) <br />1l ~ \~p~t "there are no Federal lands involved...". However, there is a US <br />S~' ~,'~/ ~~BLM tract within the proposed permit area. As such, the applicant's <br />/ ~('\ ~ ~ statement is inaccurate. Additionally, as Federal coal is involved, <br />k copies of this application must be submitted to the US Office of Surface <br />'~ Nv Mining. <br />`~ h ~ The response to Rule 2.03.4(2)(c), on page 3-4 of the application, <br />incorrectly states "Person to pay DMG" regarding AML fees. The Division <br />doesn't accept AML fees; they are paid to OSM. Please correct. <br />}q. Rule 2.03.4(2)(b> requires information on applicant's "resident agent". <br />Please remove the references to Ms. Pautsky from this section, as the <br />"resident agent" is the applicant's agent residing in Colorado that the <br />/ Division will contact in the future for inspections. <br />Xl. Rule 2.03.4(3) requires information on each person who owns or controls <br />the applicant (Oakridge Energy). On page 3-3, it is stated that OEI is a <br />~ 1M public corporation; as such, the possibility of stockholders owning <br />LX ~~ shares in the company seems to exist. Therefore, please address in <br />~, further detail as to whether there are any other entities or individuals <br />who might qualify as someone who owns or controls OEI, as described under <br />Rule 1.04(83a). Thus would include officers or directors of OEI, as well. <br />12. Rule 2.03.4(3)(b) requires discussion of owner/controller ownership <br />percentages. The application currently inadequately states "None of the <br />\\~ ~~~ individual-s-..-.-has-art-ownerst~' than 50 percent". Please state <br />L'd) ~ ~ what Che ownership percentages o~p~ all o er/controllers are, and the <br />V-~ precis~~~~es <br />N~ <br />~a~ <br />
