Dan Mathews -2- <br />I recommend that we proceed as follows: <br />I~cember 29, 1981 <br />(I) Roy Cox should review the abandonment plan to determine whether or not <br />effluent flow might occur from the portals, which will also need to be <br />determined for other hydrologic quality purposes. <br />(2) If no effluent flow will occur into-the bench and backfilled materials, <br />and if the applicant receives approval of a request for variance from approximate <br />original contour based upon steep slope conditions, the partial backfilled <br />configuration could be approved with the condition that the backfilled configur- <br />ation be monitored for a period of at least 2 years, utilizing some acceptable <br />surface surveying technique, in order to assure stability. <br />(3) If the operator does not desire to file an acceptable request for <br />variance from approximate original contour, then the operator should be required <br />to complete the total backfilling configuration including the 20 foot high by <br />30 foot wide toe buttress berm throughout the length of the existing portal <br />bench. <br />/mt <br />cc: Fred Banta <br />David Shelton <br />Roy Cox <br />
