The staff has had an opportunity to review the appli- <br />cation for adequacy. Our concerns are noted below. <br />General Application Quality <br />The current submittal for fee land only is 56 loose leaf, rouyh copied <br />pages inserted in a folder. 41e suggest a 3 ring binder. <br />Application Form <br />Under "other mining permits and operations in Colorado no mention teas <br />made of the Lincoln or Imperial Mines. Permits are on record for these <br />operations. Outstanding reclamation responsibilities for the Lincoln <br />mine may hold any furture permiting for Sunflower Eneryy Operations in <br />abeyance. Section 120 of the IAined Land Reclamation Regulations <br />prol;~brt5 granting new permits to an operator who is in violation of <br />any section of the Article. Our attorney is investigating the matter <br />to see if it may bear upon possible Board Action on the 61ue Ribbon <br />Mine. The application for fee land only is unsigned and therefore not <br />valid. <br />Exhibit A <br />Some confusion arises as we try to determine the total amount of affected <br />area vis-a-vis the total permit area. A permit area of 40.2 acres is <br />mentioned in the legal description. Exhibit C shows 39.7 acres and <br />exclude the trucl: scales. A map which clearly shows the entire permit <br />area and all proposed surface affected acreage should be prepared. Does <br />the 18.7 acres of disturbance exclude truck scales and tracts 3 & 5 <br />acres? 41hat uses are proposed for tracts 3 & 5? <br />Exhibit C Mininq Plan Ma <br />:deral Coal <br />The preliminary mine layout map shows plans for mining federal coal. <br />The state can not unilateraly approve a mine plan for federal coal. <br />Only fee coal should be shown on the rlnining plan map.
