Exhibit 15-14 has been revised to reflect the volume and construction designs for Pond
006.
~~~ 85. LCC accepts a stipulation on the issues identified in question 85.
~~ 90. LCC is now planning to replace topsoil throughout the Jeff Canyon surface mine. Coazse
`~ ~~ fragments from the use of overburden as a plant growth medium should not pose a problem.
In the unlikely event that there is excess topsoil, it will be distributed in azeas identified as
needing topsoil. Language has been put into 2.05-59a.
91. LCC would like to take a phased approach to the geotechnical investigation of the fills at the
Jeff Canyon surface mine. This would expedite mining in the first two yeazs of the
operation, minimize disturbances in the eastern portions of the Jeff Canyon Mine to ensure
proof-of-concept and allow LCC and the Division to identify patterns and relationships in
• the area which might lead to a more focused and efficient investigations in the future.
Phased investigations were previously discussed between Mazk Gray and Jim Pendleton, and
LCC was of the understanding that this would be acceptable. The purpose of providing the
methodology was to obtain approval from the Division's engineer of the protocol such that
the future, stipulated submittal would be applicable to meet the requirements of Rules
2.05.3(6)(6) and (c) and 4.09 at Fills 1 through 4. Is there a way to structure the stipulation
to allow phased geotechnical investigations?
O~ 98(c). Page 2.05-37a has been modified to reflect the correct map, 2.03.3-4.
102. LCC will request that Picketwire to modify the New Elk permit to permit the disposal of
,~ 1Q Lorencito refuse at the New Elk disposal site.
5n,~ 103. LCC has requested a stipulation to cover the geotechnical issues at the site.
(~ 5,~1'~ 110. LCC will provide the applicable air permits as they aze finalized.
\`\1~^
Sn~ 111. LCC accepts a stipulation to develop a shrub reclamation plan.
~~
~]~~ 114. LCC will provide joint approval documents from the CDMG Mine Safety and Training
`~ 5~~~ ~ Program and MSHA to perform concurrent surface and underground coal mining activities
~ 1 5'~ when it is available, and accepts the stipulation.
•
