1
' We believe that the inclusion of this species is warranted for these
' reasons, and that its inclusion at the seeding rates specified should
not, with proper grazing management, precipitate the problem of
crested wheatgrass dominance commonly experienced elsewhere.
' At this time, The Rockcastle Comapany does not have adequate resources
to conduct afull-scale revegetation research or data gathering program,
and cannot make such a commitment.
' As time goes on, revegetation work will be monitored and inspected
by both company and regulatory personnel. ]f at any time problems
become apparent, seed mixtures and other revegetation practices will
be modified as deemed appropriate.
6. During past site inspections, Division Reclamation Specialists have noted
evidence of sheep grazing on newly reclaimed areas. Rule 4.15.5(2) specifies
that grazing not be allowed on reclaimed areas until the Division has been
' satisfied that vegetation is adequately established. The applicant should provide
a plan for excluding sheep from newly reclaimed areas.
' A letter, dated November 26, 1983, has been transmitted from Mark
L. Korb, attorney for The Rockcastle Company, to Dan Mathews of
the Division of Mined Land Reclamation, in which efforts to control
livestock grazing were outlined, as well as some historical background
' on the situation.
Based on that letter, the following plan is proposed if areas around
the mine are leased for grazing in the future:
1. Keeping contact with the surface owner to determine whether
or not there will, in fact, be grazing in 1984.
2. If no grazing is contemplated no further action will have to be
taken.
' 3. If grazing does become known as a probable use, we will propose
to identify and delineate the areas where grazing could be permitted
and, if at all possible, strictly prohibit grazing any place above the
juncture in the former pit access road where the pet access road
comes into the main haul road adjacent to Grassy Creek.
4. When the sheep are brought to the site, the sheepherder would be
specifically shown the prohibited areas and given specific requests
to avoid permitting sheep to get into those areas.
5. In addition, personnel from the Rockcastle Company would periodi-
' cally check the "off limits" in order to prevent access by livestock.
In view of the fact that there is no present expectation of grazing
' in this area, we feel that this is an appropriate response to the Division's
request.
' 7. The applicant has stated that broadcast or hydroseeding rates will be
