These are: <br />(a). The statement on page IV-43 that "minor settling ui' strata in <br />the AVF will not diminish the farming capability" is <br />C~'~~~ ~ unsupported. Empire Energy Corporation roust demonstrate that <br />,r'OM\'~_ this statement is warranted. To do this the applicant will have <br />to identify the hydrologic functions cf the AVF as stated in the <br />section amJ deterarine the effects of subsidence on these <br />hydruluyic fwi~Liuu•s. <br />~ (V). The section on "Description of worst Possible Consequences" must <br />contain a description of wurst possible Consequences Fur m•ixi~i~w~i <br />subsidence beneath both the Ya~upa and Willia~us Fork lovers and <br />alluvial aquifers. The information is required to detennine to <br />~ probable hydrologic consequences of mining as discussed in tnat <br />section. , <br />(c). Un page IV-142 the applicant states that "in the event of <br />material damage to the irrigation ditches, they will be <br />~ repaired". Empire Energy Corporation must co~ronit to~~naintaininy <br />(~o the irrigation syste~» in a "functional condition". <br />S7IPULHT?U'1S - <br />Tnese concerns could ue stipulated as conditions to the permit. <br />7hrouyhout Section 4.6, "Subsidence Control Plan", of Lhe amended <br />application, an inconsistency exists concerning which areas of the mine <br />plan will be the subject of partial extraction. The applicant indicates <br />in various sections of the application that the Williams Fork and Yampa <br />Rivers will oe protected from subsidence occurrence through liritation of <br />mining beneath the rivers. Uther sections of the application ,.odressiny <br />control of subsidence fail Co mention the rivers. This ambiguity roust ue <br />resolved i~ order to avoid significant future probla,~~s for the applicant. <br />It is the Division's understanding that the "BUFFER ZOIVES" lightly <br />depicted upon Flap IV-1 are those areas within which the applicant pro,~o5es <br />to lin;it extraction Cu rounr and pillar develop+nent upun advance.
