. t <br />~' <br />L.A.C. 91-04 <br />A RESOLUTION OF THE BOARD <br />OF THE <br />LAS ANIMAS COUNTY COMMISSIONERS <br />WHEREAS, Rimrock Coal Company has filed application #SUP90-012 <br />for a Conditional Use Permit to operate a strip mine <br />on property located on Engleville Tract NWh of Section <br />29, T33S, R63W and <br />WHEREAS, All necessary data has been submitted with application <br />#SUP90-012, and <br />WHEREAS, The Las Animas County Planning Commission has reviewed <br />appication #SUP90-012 and made a decision to deny <br />said application, and forwarded said application to <br />the board on November 20, 1990 and <br />WHEREAS, A public hearing was held November 20, 1990 at 10:30 <br />a.m. in the Chambers of the Board of County <br />Commissione=s, to receive comment on application <br />#SUP90-012 now, therefore, be it <br />RESOLVED, That the Board of Las Animas County Commissioners <br />does hereby grant approval of application #SUP90-012 <br />subject to the following conditions: <br />1. Rimrock Coal Company will be required to furnish <br />a performance bond in the amount of $53,000 to secure <br />site restoration, road and bridge repair, repair for <br />any other damaged property of the County and 'any further <br />reclamation. At least ten percent (10~) of the <br />performance bond shall be in cash deposited with the <br />Las Animas County Treasurer and shall be placed in <br />an earmarked Escrow Account mutually agreeable to <br />the Board of County Commissioners and to the Applicant. <br />2. Rimrock Coal Company will agree to utilize all <br />means of dust control at the mine site, on the route <br />and in the the loading zone by either wetting the <br />coal, or by the use of calcium chloride dusting. <br />
