• • CO-0012 <br />Page 10 of 13 <br />-6- <br />26. The following stipulations that are part of CWI's Federal Lease Agree- <br />ments must be satisfied. <br />a. The lessee will make an inventory of the tract for significant paleonto- <br />logic resources within 6 months of approval of the mining permit required by <br />30 CFR 710:11. If such resources are found, the mining permit will be modi- <br />fied to protect such resources, and a salvage plan will be devised and made a <br />part of the mining permit. <br />b. Colorado Westmoreland, Inc., will operate in fu 11 compliance with all <br />existing laws, rules, and regulations and take reasonable interim and iong- <br />term steps to mitigate any significant environmental impacts of increased <br />trucking on State Highway 133 resulting from increased production at the <br />Orchard Valley Mine as the need arises. <br />c. Colorado Westmoreland, Inc., will retain an independent highway consultant <br />to review the truck haul situation for the purpose of making any appropriate <br />suggestions for changes in procedures and will submit a report to Che Regula- <br />tory Authority and BLM by December 31, 1981. <br />d. Colorado Westmoreland, Inc., has applied for permission to use tandem <br />trucks on State Highway 133 which would double the coal hauling capabilities <br />of each truck without significantly increasing the number of monthly tripe <br />from the mine to the train loadout. If such permission is granted, Colorado <br />Westmoreland, Inc., will change Co the tandem trucks as soon as possible and <br />until then CWI will keep the Regulatory Authority and BLM appraised of [he <br />status of the permit. <br />e. In reclamation and rehabilitation, the lessee shall apply only enough <br />water to meet the consumptive use of the vegetation. <br />
