• • co-oolz <br />Page 9 of 13 <br />-5- <br />addition to the inspection and reporting requirements of Rule 4.10.2, CWI <br />shall submit records or calculations to verify the total accumulated quantity <br />of coal processing waste disposed of at the existing site as a portion of its <br />quarterly inspection report to be submitted to the Regulatory Authority. <br />22. The applicant must provide to the Regulatory Authority as part of Phase <br />II of the stability analysis study being conducted under the direction of Mer- <br />rick 6 Company, a demonstration that the existing haul and access road embank- <br />ments have achieved a minimum safety factor of 1.25, and that the existing <br />haul and access road cuts have achieved a minimum safety factor of 1.50 or <br />that a lesser safety factor will not result in significant environmental harm <br />or harm to the public health and safety, or provide a plan to upgrade the <br />roads to a safety factor acceptable to the Regulatory Authority. This demon- <br />stration shall be completed and a report su®sarizing the results and method- <br />ology thereof submitted to the Regulatory Authority for review by December 31, <br />1981. <br />23. Within 30 days after [he completion of Phase III of the stability <br />analysis and redesign of the final reclaimed configuration of the surface <br />facility area of the Orchard Valley Mine, the applicant must submit to the <br />Regulatory Authority a revised backfilling and grading cost estimate Eor the <br />surface facility area. If this revised cost figure is greater than the <br />present estimate, the amount of the reclamation bond will be increased <br />accordingly. <br />24. The operator is directed by the Regulatory Authority to install the moni- <br />toring network shown on Map 28B above the 5 north panel of the 8th East Main <br />prior to November 1, 1981. In order to determine the adequacy of the simplis- <br />tic monument proposed for use in this network, the applicant shall install ap- <br />propriate benchmarks to allow quarterly monitoring of the monument network for <br />a minimum of 9 months prior to mining within the subject panel. Prior to the <br />installation of the monument network benchmarks, the operator shall obtain ap- <br />proval from the Regulatory Authority of the benchmark's location and construc- <br />tion. Following receipt of that approval, the operator shall amend Map 28B to <br />indicate the location of the approved benchmarks. <br />25. The Regulatory Authority directs Colorado Westmoreland, Inc. to submit <br />reports to its subsidence monitoring program on a semi-annual basis, commenc- <br />ing one month after the installation and initial surveying of the subsidence <br />monuments. Further, due [o the complexity of the permit area, geology, <br />presence of steep slopes, and sensitive hydrologic elements, Colorado West- <br />moreland, Inc. is directed to submit a proposed subsidence monitoring report <br />format to the Regulatory Authority for approval. This report Eormat should <br />recognize the importance of continual update of subsidence data interpreta- <br />tion, monitoring of groundwater levels and spring flows, monitoring of mine <br />inflow, and subsurface ground conditions which could be correlated to subsi- <br />dence prediction. This report format shall be approved by the Regulatory <br />Authority prior to the commencement of extraction of coal within the 5 North <br />panel off the 8th East Main of the Orchard Valley Mine. <br />
