Crane, Regional Director <br />Office of Surface Mining, Denver <br />Attn: Floyd Johnson <br />From: District Manager, Montrose <br />Subject: Colorado Westmoreland, Inc., Orchard Valley `fine <br />My staff have reviewed the additional information submitted by Colorado <br />Westmoreland, Inc., as requested by the memorandum dated July 27, 1981 <br />(enclosed) and they have no additional comments. <br />The unsuitability criteria have been applied to Federal Coal Lease C- <br />27432, and no part of the federal lands examined were unsuitable for <br />surface coal mining operations within the meaning of Section 522 of the <br />~`~ Surface Mining Control and Reclamation Act. <br />Most of Che stipulations contained in the lease (enclosed) have been <br />included as part of [he mine plan. However, the following stipulations in <br />the lease should be specifically addressed in the mine plan permit. <br />Section 30: <br />(d) The lessee will make an inventory of the tract for significant <br />paleontologic resources prior Co the approval of the mining permit <br />required by 30 CFR 710:11. IE such resources are found, the mining permit <br />will be modified to protect such resources, and a salvage plan will be <br />devised and made a part of the mining permit. <br />(f) Colorado Westmoreland, Inc., will operate in full compliance with all <br />existing laws, rules, and regulations and take reasonable interim and long- <br />term steps to mitigate any significant environmental impacts of increased <br />trucking on State Highway 133 resulting from increased production at the <br />Orchard Valley Mine as the need arises. <br />(g) Colorado Ides[moreland, Inc., will retain an independent highway con- <br />sultant to review the truck haul situation for the purpose of making any <br />appropriate suggestions for changes in procedures. <br />-.^ <br />:~ <br />
