Crane, Regional Director Office of Surface Mining, Denver Attn: Floyd Johnson From: District Manager, Montrose Subject: Colorado Westmoreland, Inc., Orchard Valley `fine My staff have reviewed the additional information submitted by Colorado Westmoreland, Inc., as requested by the memorandum dated July 27, 1981 (enclosed) and they have no additional comments. The unsuitability criteria have been applied to Federal Coal Lease C- 27432, and no part of the federal lands examined were unsuitable for surface coal mining operations within the meaning of Section 522 of the ~`~ Surface Mining Control and Reclamation Act. Most of Che stipulations contained in the lease (enclosed) have been included as part of [he mine plan. However, the following stipulations in the lease should be specifically addressed in the mine plan permit. Section 30: (d) The lessee will make an inventory of the tract for significant paleontologic resources prior Co the approval of the mining permit required by 30 CFR 710:11. IE such resources are found, the mining permit will be modified to protect such resources, and a salvage plan will be devised and made a part of the mining permit. (f) Colorado Westmoreland, Inc., will operate in full compliance with all existing laws, rules, and regulations and take reasonable interim and long- term steps to mitigate any significant environmental impacts of increased trucking on State Highway 133 resulting from increased production at the Orchard Valley Mine as the need arises. (g) Colorado Ides[moreland, Inc., will retain an independent highway con- sultant to review the truck haul situation for the purpose of making any appropriate suggestions for changes in procedures. -.^ :~
