Please include the plans as presented to the State Engineer and/or MSHA as an exhibit to the <br />• permit for those ponds within an embankment height in excess of 10 feet or 20 feet, as <br />applicable (Rule 2.05.3(4)(a)(iii)). <br />Response <br />LCC will provide preliminary MSHA designs for ponds 001, 002, and 003 in the fall of <br />1997. These packages require substantial foundation and material testing which is better <br />accomplished once access is developed following permitting. LCC will provide approved <br />MSHA designs when received. MSHA submittals for ponds 005, 007, 008, and 009 will be <br />provided nine months prior to construction, and final approvals will be submitted to the <br />Division prior to initiation of disturbance in the overlying watersheds. <br />86. Rule 2.05.3(4)(ii)(c) requires a description of the operation and maintenance requirements <br />of each pond. Permit text states that ponds will be cleaned out at approximately 60 percent <br />of the 3 yeaz sediment storage capacity. How will this be determined in the field? How will <br />cleaning be done? Where will pond cleanings be disposed? Please modify and expand <br />permit text. <br />Response <br />The sediment level in ponds will be visually approximated during the quarterly pond <br />• inspections, as water level conditions permit. Cleaning will be done during dry periods of <br />year, typically between fall and mid-winter or in eazly summer when the pond sediments <br />have had an opportunity to dry out. Depending on their portability, cleanings may be stacked <br />upstream yet adjacent to the pond to dry out, or they may be immediately taken to the surface <br />mine for disposal in the pit. This information has been included on revised page 2.05-33. <br />Rule 2.05.3(5) Operation Plan -Topsoil <br />87. In the last paragraph on application page 2.05-3, it is stated that "topsoil will be salvaged and <br />stored in stockpiles". Will this also occur for subsoils (Section 2.05.4(2)(d))? Will subsoils <br />be segregated from topsoils? (DIH) <br />Response <br />Lorencito Coal Company is planning to salvage commingled A and B horizons of soils <br />located in slopes which are less than 30%. There is no plan to salvage the C horizon subsoils <br />or soils which are unsuitable for plant growth medium due to a high coarse fraction content. <br />88. Mine Plan Map 2.05.3-1 is the only map which depicts the proposed location of the topsoil <br />piles. Please provide information on the volttmes of the topsoil stockpiles. This information <br />is necessary for the Division to conduct cost estimate verification. <br /> <br />25 <br />
