Under <br />"Hollow Fill Construction" on page 2.05-10, a sentence has been added to the text indicating <br />this. <br />72. On page 2.05-40, it is stated that "Underground development waste from fault crossings, <br />overcast development, or roof rock will either be deposited in underground gob rooms or be <br />placed in the surface mine backfill". By definition (1.04(22)), underground development <br />waste is also "coal mine waste". As such, Section 4.11.3 of the Regulations allows <br />underground development waste to be returned to undergrotmd mine workings ("gob rooms") <br />only in accordance with a waste disposal program approved by both the Division and MSHA <br />under Section 2.05.3(a) of the Regulations. Please provide this information. <br />[f the applicant, rather than placing underground development waste in underground <br />workings, would rather place this material in the proposed spoil fills, the information <br />required by Section 4.09.1(12) of the Regulations must be provided. <br />• Respsnse <br />Section 2.05.3(9) on page 2.05-40 has been modified to reflect that underground <br />development waste will be stored in abandoned workings in plans approved by both the <br />Division and MSHA. In addition, Section 2.05.3(8) on revised page 2.05-40 has been <br />changed to reflect a generic plan for the disposal of gob or lithic non-coal processing waste <br />in the surface mine area. This general plan would be supplemented through the revision <br />process with site specific plans and maps ~s the need for such a structure azose. <br />Rule 2.05.3(3) Mine Facilities ~ <br />73. It is stated in the second paragraph on page 2.05-10 that "Shale and other extrarteous material <br />sepatated from the coal prior to loading will be left in the pit or placed with the overburden." <br />As the definition of "coal processing waste" (Rule 1.04(24)) is "earth materials which are <br />separated and wasted from product coal...", it could be construed from this sentence that <br />"processing" of coal will occur at the surface mine prior to being trucked to the loadout <br />facility. A description of the coal processing facility or equipment planned at the surface <br />mine would then be required. If processing is not intended, however, then this sentence <br />should be reworded. <br />• It should be noted that Section 4.26.2(4)(c) of the Regulations requires the top of the <br />underburden immediately below the lowest coal seam mined by mountaintop removal <br />21 <br />
