In our discussion on February 10, I <br />expressed my disappointment and surprise that Michael Savage <br />took so long to write his letter of January 26, 1984, and then <br />imposed no time limit within which the permittee was required <br />to respond to the questions raised in my letter of January 13. <br />Although I attempted to explain my client's position with <br />respect to this matter, I note that your recent correspondence <br />still does not establish a definite time frame for Mr. Pascoe's <br />reply. <br />The permittee, Trinidad Basin Mining, Inc., continues to <br />mine coal belonging to my client, Victor-American Fuel Company, <br />without any documented or "colorable" legal right. My client <br />incurs damage, in the form of depletion of an irreplaceable <br />resource, each day that this mining is allowed to continue. We <br />have initiated litigation in the United States District Court <br />to establish that the permittee is guilty of intentional tres- <br />pass and to recover damages arising from such trespass. To <br />date, however, the defendants in that litigation have success- <br />fully employed delaying tactics enabling the illegal mining <br />operations to continue. The trial has now been tentatively set <br />for mid-July which could allow the permittee to totally exhaust <br />my client's coal in Section 15. In furtherance of the delaying <br />tactics employed in that litigation, the defendants have filed <br />with the court and attempted to utilize as evidence of their <br />right to mine, the referenced Mining Permit issued by the Mined <br />
