0 <br /> <br />Rule 2.03 - Legal and Financial, Compliance <br />1. The address for the Guilianos, the land owners, was not provided in <br />the permit application. <br />2. The insurance policy presented in appendix B does not cover the <br />operation as required by Rule 2.03.9. The certificate must provide for <br />minimum coverage of $300,000 for each occurrence for both personal injury <br />and property damage protection. <br />3. Rule 2.03.12 requires that the applicant provide proof of <br />publication of the newspaper advertisement which stated that a permit <br />application was submitted to the Division. The proof of publication is <br />usually a signed document from the newspaper which shows a photocopy of <br />the advertisement. <br />Rule 2.04.3 - Land Use <br />1. The applicant must provide a map of the premining land use and the <br />postmining land use to comply with Rules 2.04.3 and 2.05.5. <br />Rules 2.U4.1U. 2.05.4 and 4.15 - Vegetation <br />1. How many acre s. of previously mined land and how many acres of <br />pinyon-juniper woodland are in the surface disturbance areal <br />2. Provide a vegetation map, pursuant to Rule 2.04.10(1), showing the <br />vegetation communities. <br />3. Since most of the area is classified as previously mined land, it <br />is necessary to develop a reclamation standard, per Rule 4.15.10(1). <br />Therefore, the standard will be based on the yround cover that can be <br />supported by the growth medium and the ground cover that is adequate to <br />control erosion. Nn analysis of the re vegetation growth medium is needed <br />and an estimate of the minimum ground cover needed to control erosion on <br />the reclaimed hillslope is necessary to establish the success standard. <br />The issue of sampling of the growth medium is addressed under the Soils <br />section of this letter. <br />4. The applicant has not adequately described the seeding and planting <br />methods. In what season will the area be seededY Four different seed <br />mixes are presented. Which one is proposed? The text says seed mixtures <br />will be applied at the rate of fifteen pounds per acre and seed will be <br />applied by broadcast methods. Usiny broadcast methods, seed should .be <br />applied at thirty pounds per acre. Fifteen pounds would be adequate for <br />drill seediny. Therefore, the applicant needs to clearly explain, in the <br />text, the time of year for seeding, the proposed seed mixture and the <br />appropriate seeding rate. <br /> <br />
