<br />SURFACE' MINING LEASE AGREEMENT
<br />THIS AGREEMENT OF LEASE is made and entered into
<br />this the day of April,
<br />WICGINS, of Route 2, Box 80-C,
<br />of the First Part, hereinafter
<br />MINING, INC., and VANL'E MILLS,
<br />Colorado = 81082, Party of the
<br />"LESSEE".
<br />1982, by and between JOHN AL VIN
<br />Trinidad, Colorado = 81082, Party
<br />called "LESSOR", and TRINIDAD BASIN
<br />President, of P. O. Box 783, Trinidad,
<br />Second Part, hereinafter called
<br /> W I T N E S 5 E T H
<br />That for and in consideratio>: of t%te terms, conditions and
<br />covertants as hereinufter set forth, tae parties hereto agree as
<br />follows:
<br />I.
<br />Lessor hereby leases, Zeta and demises unto Lessee and its
<br />assiyns, all of the surface rights necessary, usual and convenient
<br />in t3te mirtiny and removir:g of coal by deep, auger, strip, contour
<br />or any other method of nrininy coal from in, under and upon all
<br />that certain piece, parcel or tract of Zand situated in Las Animas
<br />Coun6y, Lblorado, and containing 55 acres, more or Zess.
<br />Being the same Zand described in that deed of conveyance to
<br />Lessor by LiZZian Wiyr~ins, deed dated the 9th day of February,
<br />1979, and recorded in Ueed Book 795 ort Paye 191, and described
<br />in Exhibit "A" attacyeed hereto.
<br />Together with all mining rights and easements owned by Lessor
<br />and appurtenant to the coal and Zand herein described, including
<br />the full, exclusive r•iy:tt of ingress, egress and regress, in and
<br />to and upon said Zartd for the purpose of exploring for and mining,
<br />manufacturing, testing, preparing said coal for market, to build
<br />roads, buildings, tipples and chutes, to deposit matevial and re-
<br />fuse on surface of the Land, to build wire and pipe lines, to
