Star Route Box 52A Pagosa Springs, Colorado 81147 Re: Martinez Strip - Our File No. C-023-81 Dear Mr. Orell: The purpose of this letter is to convey to you certain preliminary concerns which have been identified in the MLRD review of your application referenced above. This report constitutes the 60-day notification of preliminary findings as to the substantive adequacy of your application, pursuant to CRS 1973, 34-33-118(5), as amended. I would like to stress the preliminary nature of this report, as the review of your application cannot be completed without the benefit of additional information. Additional comments will be forthcoming as our review progresses on the issues raised in this preliminary report, and on other issues as they arise. All responses to deficiences identified in this review, and any other re- visions or modifications you want to make to the permit application, must be submitted as revisions to the existing application, not as additional submissions. In order that the Final permit document will remain as compre- hensive and concise as possible, all revisions should be prepared in a manner that will facilitate their insertion/substitution in the existing application; this must be done for all 6 copies (MLRD - 5, county clerk - 1). In order that we may have adequate time to review your responses to the deficiencies identified in the enclosed review and incorporate the results of this new material into the written findings the Division must make prior to issuence of a permit, it is essential that Chimney Rock Coal respond as expeditiously as possible. The time schedule we are currently working under requires that the Division issue a proposed decision by June 18, 1981. If Chimney Rock Coal submits a complete and adequate response package by May 22, 1981, the Division would most likely be able to complete its review within the time frame specified in the Colorado Surface Plining Control and Recla- mation Act of 1979.
