Section 816.72 - (Disposal of excess spoil: Valley Fills) - In view <br />of the fact that this application permit is to replace the current <br />permits for Energy 111 6 2 mines, the submittal should contain a dis- <br />cussion of the fill associated with the 16284 box cut. <br />Section 816.72(b)(i)(ii) - Comparing Figures 2 ~ 3 in Exhibit 9, it <br />~• does not appear that the underdrains extend from the toe to <br />the head of fill. This is contrary to the requirements of this sub- <br />section. vAAiM~CE <br />19. Section 816.89(a) - As mentioned in previous memo, the other two ponds <br />located adjacent to the shop facilities need to be reconstructed. <br />20. Section 816.95 (Air resources protection) - The application does not <br />include sufficient information to demonstrate compliance with all parts <br />of 816.95(b). We may want to grant variances for 816.95(b)(3), (8), <br />(9), (12), and (16). <br />21. Section 816.95(c) (Air Resources Protection) - The regulatory should <br />make the determination that no additional fugitive dust control measures <br />are required, If additional measures are required they will be brought <br />to the attention of EFC. <br />22. Section 816.97(c) (Protection of fish, wildlife, and related environmental <br />values) - Please refer to prior memo, item ~i10 under Operation Plan. <br />23. Section 816.97(d)(4) (Protection of fish, wildlife, and related environ- <br />mental values) - As stated in the application, a sage grouse strutting <br />ground is located within the permit area, therefore it is possible that <br />EFC may have to undertake a habitat enhancement program to mitigate <br />adverse effects on the sage grouse. <br />24. Section 816.101(a) (Backfilling & Grading: General Requirements) - The <br />box cut for the 7400 pit should also be included in the narrative on <br />page 816-125. <br />
