Tate -3- February 17, 1982 <br />(b) A brief description of tl~e particular violation alleyed in the notice; <br />(c) The date, location and type of any administrative or judicial <br />proceedings initiated concerning the violation, including, but not Limited to, <br />proceedings initiated by the applicant to obtain administrative or judicial <br />review of the violations; <br />(d) The current status of the proceedings and of the violation notice; <br />(e) The actions, if any, taken by the applicant to abate the violation; and <br />(f) The final resolution of any notice of violation. <br />2.04.3 General Requirements: Site Lhscription and Land Use Information <br />All of the information required by Sections 2.04.3 (pre-mining land use) and <br />2.05.5 (post-mining land use) has been provided. The locations of the pertinent <br />exhibits is mislabeled in the body of the application. Exhibit A is listed on <br />page 16 of the application as pertaining to the pre-mining land use. Tf~is <br />exhibit is, in fact, tl~e mine plan. Exhibits K and L pertain to the pre- and <br />post-mining land uses. Dlue Ribbon Coal Company must provide revised versions <br />of page 16 which correctly identifies Exhibit K as the map of pze-mining land <br />use. Additionally, Exhibits K and L need to be revised to include the Blue <br />Ribbon truck scale facility. <br />2.05.4 Reclamation Plan <br />While re viewing the reclamation plan, a problem with reclamation timing was <br />identified. There occurs a statement on pages 108-I09 that ..."reclamation of <br />the portal bench, access roads, sediment ponds, coal stockpiles and truck scale <br />site will be concurrent." The rules specify that sediment ponds must remain <br />in place until the water from the site meets effluent limitations without <br />treatment, state receiving stream standards .end that vegetation success <br />criteria have been met. The proposal to reclaim sediment ponds concurrently <br />with other reclamation activities is unacceptable. Blue Ribbon Coal Company <br />must revise the reclamation plan to show that sediment ponds will remain in <br />place until all of the conditions specified in 9.05.6(9) have been met. <br />Geology <br />BZue Ribbon Coal Company has submitted a generalized geologic map (Exhibit R) <br />which only covers the surface disturbance area. This map does not adequately show <br />the geology of the permit and adjacent areas. Blue Ribbon Coal Company has <br />committed to submitting a new map with the site-specific geology after the snow <br />melts and field work can be conducted (see legend of Exhibit R). Blue Ribbon <br />Coal Company has also agreed to plot the croplines of the alluvium in Hubbard <br />Creek on a new hydrology map. When the Division receives the hydrology map, <br />there will be sufficient geologic information in the permit to make written <br />findings, <br />
